Terms of Service

1. Acceptance of Terms

By accessing or using Lumart AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Account Responsibilities

• You must provide accurate information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials and API keys.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to use the Service.

3. Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, or abusive content.
• Create content that infringes on copyrights, trademarks, or other intellectual property rights.
• Generate content depicting minors in inappropriate contexts.
• Attempt to reverse-engineer, compromise, or overload the Service.
• Circumvent rate limits, usage quotas, or other technical restrictions.
• Resell access to the Service without authorization.

We reserve the right to suspend or terminate accounts that violate these guidelines without prior notice.

4. Stars & Billing

• Stars are the internal credit unit used to pay for AI generations and API calls on the platform.
• Star packages are purchased in advance and are non-transferable between accounts.
• Purchased Stars do not expire unless your account is terminated.
• Pricing and Star costs for different models and features may change at any time. We will provide reasonable notice for material changes.
• Failed generations are not charged. Stars are only deducted upon successful completion.

5. API Usage

• API access is provided via API keys issued through your account dashboard.
• You must keep your API keys confidential. Compromised keys should be revoked immediately.
• API usage is billed in Stars, the same as interactive generation.
• Rate limits and usage caps may apply. Exceeding these limits may result in temporary throttling.

6. Intellectual Property

• Your content: You retain ownership of content you generate using the Service. Generated content may be used commercially unless the licence of the specific upstream model used restricts it (each model's licence is visible on the pricing and model pages).
• Your inputs: You must hold the legal rights to any images, text or other materials you upload. By submitting them, you grant Lumart a temporary licence to process them solely as needed to fulfil your generation request.
• Our platform: The Lumart AI platform, brand, user-interface design, brand assets and proprietary technology remain our intellectual property.
• Prompts: Prompts you submit are logged for billing reconciliation, debugging, abuse detection and platform security review. We do not use your prompts to train any third-party AI model, and we do not participate in upstream providers' training-data programmes.
• Generated content review: For safety, compliance and abuse response, Lumart may apply automated and human review to generated content. We do not use your generated content for public marketing or for model training unless you separately authorize us.
• Trademark & DMCA: If you believe content on the Service infringes your intellectual property rights, you may submit a DMCA takedown notice to security@lumart.ai.

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that AI generations will meet your specific requirements. To the maximum extent permitted by law, Lumart AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

8. Termination

• You can delete your account at any time from Dashboard → Settings → Account → Delete account. Deletion has a 7-day cooling-off period during which you can cancel; after 7 days the account and its data are permanently removed.
• We may suspend or terminate your account for violation of these Terms, illegal activity, or extended inactivity.
• Upon termination, unused Stars are non-refundable unless otherwise required by law. See our Refund Policy for details.

9. AI-Generated Content

You are solely responsible for the prompts you submit and the outputs they produce. AI models can hallucinate, produce inaccurate or biased content, and on rare occasions output material that resembles existing copyrighted works. Before publishing, broadcasting or commercially exploiting any output, you should:

• Independently verify factual claims, especially in regulated domains (medical, legal, financial).
• Review the licence of the specific upstream model used (visible on the pricing and model pages). Some models reserve commercial use for paid tiers.
• Avoid using outputs as a substitute for the likeness, voice or identity of real persons without their explicit consent.

Lumart provides best-effort safety filters but does not pre-screen every generation. If you encounter content that violates these Terms, please report it to security@lumart.ai.

10. Governing Law & International Use

Lumart AI serves customers globally. Unless prohibited by your local mandatory consumer-protection law, these Terms are governed by the laws of the jurisdiction in which Lumart AI is operated, without regard to its conflict-of-laws principles. Disputes will first be addressed through good-faith negotiation; if unresolved, they will be settled by binding arbitration where permitted.

You are responsible for complying with the export-control, sanctions and content laws of your own jurisdiction. The Service is not available where its use would violate local law.

11. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
